Investors Sue Deutsche Bank and HSBC For $250 Million In RMBS Losses

On March 28, 2012, investors sued a Deutsche Bank AG affiliate and HSBC Bank USA NA over residential mortgage-backed securities, alleging that the defendants misrepresented the quality of the loans in the securities, causing the investors to lose $250 million. In the summons with notice, the investors allege that DB Structured Products, the originator of the loans, made false statements about both the quality of the loans in the securities and the borrowers under the mortgages. Plaintiffs allege that HSBC, the trustee for the securities, failed in its duty to make DB Structured Products repurchase the loans at issue. The case is captioned RMBS Recovery Holdings 4 LLC, et al. v. DB Structured Products Inc., et al., case number 650980/2012, in the Supreme Court of the State of New York, County of New York.
